Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SpamSlayer ("the App") or its associated backend services ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you") and SpamSlayer ("we," "us," "our"). We reserve the right to refuse service to anyone for any reason at any time.

2. Description of Service

SpamSlayer is a spam call screening application consisting of:

• An Android application that identifies and screens suspected spam calls using Android's CallScreeningService API on your device.
• A cloud-based AI agent ("Eleanor") that can answer forwarded spam calls on your behalf, engaging suspected scammers to waste their time and gather intelligence.
• Call forwarding infrastructure powered by Twilio, which routes suspected spam calls to the AI agent via a dedicated phone number assigned to your account.
• A community spam database that aggregates anonymized spam call data across users to improve detection for everyone.
• Call transcripts and scam intelligence stored per-user for your review.

The Service relies on third-party providers including Twilio (telephony), Deepgram (speech-to-text), Google Gemini (AI language model), Google Cloud (text-to-speech and data storage), and Firebase (authentication and database). Availability and performance of the Service depend in part on these third-party providers.

3. Account Registration & Security

To use the Service, you must create an account using Firebase Authentication (Google sign-in or email/password). You agree to:

• Provide accurate and complete registration information.
• Keep your login credentials secure and confidential.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

We reserve the right to suspend or terminate accounts that we reasonably believe are fraudulent, violate these Terms, or pose a security risk.

4. Twilio Number Provisioning

Upon registration, each user is assigned a dedicated Twilio phone number for call forwarding purposes. You acknowledge and agree that:

• The phone number is provisioned and managed by us through Twilio and remains our property.
• The number is assigned solely for use with the SpamSlayer Service and may not be used for any other purpose.
• You are responsible for configuring call forwarding on your carrier (e.g., using USSD codes) to route calls to your assigned number.
• We may deactivate or reassign your Twilio number if your account is inactive for an extended period (90 days or more), if your subscription lapses, or if your account is terminated.
• Number availability is subject to Twilio's inventory and regional restrictions. We do not guarantee assignment of any specific number or area code.
• Standard carrier charges for call forwarding may apply from your mobile carrier; these are your responsibility.

5. Acceptable Use

You agree to use the Service only for its intended purpose of screening and managing spam calls. You must NOT:

• Use the Service to harass, threaten, intimidate, or stalk any person.
• Intentionally forward non-spam calls (e.g., calls from known contacts, legitimate businesses, or emergency services) to the AI agent.
• Attempt to exploit, manipulate, or abuse the AI agent for purposes unrelated to spam call handling.
• Use the Service to conduct or facilitate any illegal activity.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Interfere with or disrupt the Service's infrastructure, including attempting to overload servers or bypass rate limits.
• Resell, sublicense, or commercially redistribute access to the Service without our written consent.
• Use automated scripts, bots, or tools to interact with the Service outside of the official App.

We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated this section.

6. Intellectual Property

All rights, title, and interest in and to the Service -- including the App, backend software, AI persona, algorithms, designs, trademarks, and documentation -- are and remain the property of SpamSlayer.

• Your Content: You retain ownership of any data you provide (e.g., your phone number, contacts you flag). By using the Service, you grant us a limited license to process this data as necessary to provide the Service.
• Transcripts: Call transcripts generated by the Service are stored in your account for your personal use. We may use anonymized and aggregated transcript data to improve spam detection and the Service.
• Community Data: Spam number reports you contribute to the community database are licensed to us on a non-exclusive, royalty-free, perpetual basis for use in improving the Service for all users.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The spam detection will be 100% accurate -- legitimate calls may occasionally be flagged as spam, and some spam calls may not be detected.
• The AI agent will perform flawlessly in all call scenarios.
• The Service will be compatible with all devices, carriers, or network configurations.

You use the Service at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPAMSLAYER, ITS DEVELOPER, OR ITS THIRD-PARTY PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Data & Privacy

Your privacy matters to us. Our collection, use, and handling of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We collect only the data necessary to provide the Service (account info, call metadata, transcripts, spam reports).
• Call audio is processed in real-time and is not permanently stored; transcripts are stored in your Firestore account.
• Anonymized spam intelligence may be shared across the community database.
• We do not sell your personal data to third parties.
• Data processing involves third-party services (Twilio, Deepgram, Google Cloud, Firebase) which have their own privacy policies.

10. Termination

By You: You may stop using the Service and delete your account at any time through the App settings. Upon account deletion, your assigned Twilio number will be released, and your personal data will be deleted in accordance with our Privacy Policy.

By Us: We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms.
• Extended account inactivity (90 days or more).
• Nonpayment of applicable fees.
• Discontinuation of the Service.

Upon termination, your right to use the Service ceases immediately. Sections 6 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), and 12 (Governing Law) survive termination.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this document.
• Notify you through the App or via email to your registered account.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with any changes, you should stop using the Service and delete your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, USA. You consent to personal jurisdiction in these courts.
